Overview

This webinar is designed to provide Environmental Health Practitioners (EHPs) with an update on case law over the last 12 months. The cases will be relevant to Housing Standards, Houses in Multiple Occupation, and Civil Penalties. Dr Tim Everett, trainer and researcher in Environmental Health Law, will talk through the background, decisions, and potential impacts.

Learning objectives

  • Recognise the importance and limitations of case law
  • Improve your awareness of how the different Courts and Tribunals fit together
  • Understand which parts of a judgement set precedence
  • Learn how conflicting decisions are resolved

Why should EHPs attend?

EHPs are required to interpret and apply a wide range of different legislation. An awareness of case law set by the higher courts is necessary, as well as an understanding of the difference between binding and persuasive precedence.

When dealing with new laws or legal points that have not been the subject of case law, EHPs need to understand how the courts are likely to interpret such provisions.

EHPs also need to be able to steer their lawyers and the lower courts and tribunals towards those matters which have already been decided.

When decision makers are taking regulatory action, they also need to be aware of the importance of Human Rights and Equalities.
